Home Childcare Fights to Prune Neighbor's Walnut Tree

I can't get this story out of my mind. I have seen other similar stories in the past and have always wondered how they turned out.  A home childcare business wanted to get the neighbor's walnut tree pruned because of the possible risk to any nut allergic children whose families might consider them for childcare. It's an interesting situation.

  • Does the home childcare have a right to "force" their neighbor's walnut tree to be pruned? 
  • Was the town council right to preserve the tree, requiring the childcare to obtain the town council's permission for pruning?
  • Is this just a case of going too far?
  • If your child has tree nut allergies, would the presence of a walnut tree be a concern for you?
